Welcome to RoofViz. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use RoofViz.

1. Visualization Disclaimer

You acknowledge and agree that:

• Visualizations are conceptual approximations generated by proprietary rendering technology and are intended for visualization purposes only
• Renders may contain inaccuracies, imperfections, or unintended artifacts, particularly when:
  • The roof is obstructed by trees, pools, patios, or shadows
  • The home has complex or unusual roof geometry
  • Available imagery is low-resolution or outdated
  • The viewing angle is suboptimal
• Colors, materials, textures, ridges, valleys, hips, eaves, proportions, and architectural details shown in renders may vary significantly from your actual home and from actual installed products
• Renders may occasionally show incorrect roof structures, missing details, or visual elements that do not exist on your real property
• Lighting, weather, material batches, and installation methods may cause the final roof to differ in appearance from the rendered image
• Visualizations should not be used as the sole basis for purchasing decisions — always consult with a qualified licensed roofing professional for accurate measurements, material specifications, and pricing
• RoofViz makes no guarantee, warranty, or representation that any finished roof will match its rendered visualization
• You use renders at your own discretion and risk

2. No Roofing Warranty

RoofViz is not responsible for:

• Quality of contractor workmanship or installations
• Roofing materials, products, or their performance
• Building permits, inspections, or code compliance
• Project pricing, estimates, or cost overruns
• Project timelines, delays, or scheduling
• Warranties on roofing materials or labor
• Any damages, leaks, or defects resulting from roofing work

All roofing work is performed by independent contractors. Any warranties, guarantees, or disputes related to roofing projects are between you and the contractor directly.

3. Contractor Independence

Roofing professionals accessible through RoofViz are independent businesses. They are:

• Not employees, agents, or representatives of RoofViz
• Not controlled, supervised, or managed by RoofViz
• Independently licensed, insured, and responsible for their own work
• Operating under their own business terms, warranties, and agreements

RoofViz vets contractors through a review process but does not guarantee, endorse, or warrant any contractor's work, pricing, or conduct. You are responsible for independently verifying any contractor's credentials, references, and insurance before entering into an agreement.

4. Limitation of Liability

• Inaccurate or misleading visualizations
• Decisions made based on rendered images
• Disputes with contractors or roofing professionals
• Financial losses related to roofing projects
• Loss of data, unauthorized access, or service interruptions
• Reliance on information provided through the platform

RoofViz's total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to RoofViz in the twelve (12) months preceding the claim, or $100, whichever is less.

5. Payment & Subscription Terms

A) Contractor Subscriptions

Contractor subscription plans (Gold, Platinum, Diamond) are billed monthly through Stripe. By subscribing, you agree to:

• Automatic monthly recurring billing on the same date each month
• Provide accurate and current payment information
• Accept that render allocations reset each billing cycle and do not roll over

B) Token Purchases

Token packs are one-time purchases. Tokens do not expire but are non-refundable once purchased.

C) Fair Use Policy — "Unlimited" Plans

Plans described as "unlimited" are subject to a Fair Use Policy designed to ensure consistent service quality for all subscribers. "Unlimited" means a generous, high-volume allowance intended for normal business use — it does not mean infinite or unrestricted usage without any boundaries.

Under this policy:

• Unlimited plans include a fair use threshold of up to 500 renders per billing cycle (approximately 16 renders per day)
• This threshold is designed to accommodate even the busiest roofing professionals and exceeds the usage of 99% of subscribers
• If your usage consistently exceeds this threshold, RoofViz reserves the right to contact you to discuss your needs and recommend a suitable plan or custom enterprise arrangement
• RoofViz will not suspend or limit your account without first notifying you and providing a reasonable opportunity to adjust your usage or upgrade

The following activities are considered outside of normal business use and may trigger a fair use review:

• Automated or scripted rendering (bots, scraping, bulk API calls)
• Sharing account credentials with multiple businesses or unauthorized third parties
• Reselling or redistributing renders generated through your account
• Generating renders for purposes unrelated to roofing sales or consultations

RoofViz reserves the right to modify the fair use threshold at any time. Subscribers will be notified of any changes at least 30 days in advance via email.

D) Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

E) Refund Policy

Subscription fees and token purchases are generally non-refundable. Exceptions may be made at RoofViz's sole discretion for documented service failures.

6. Lead Services

If you are a roofing professional receiving leads through RoofViz:

• Leads are provided as-is based on homeowner-submitted information
• RoofViz does not guarantee lead accuracy, homeowner intent, or conversion rates
• Lead pricing and availability may change at any time
• You agree to contact homeowners professionally and in compliance with all applicable laws
• You agree not to share, resell, or redistribute leads received through RoofViz

7. SMS & Communication Consent

By providing your phone number and using RoofViz, you consent to receive:

• SMS verification codes for identity confirmation
• Appointment confirmations and scheduling messages
• Project-related communications from RoofViz and partnered roofing professionals

Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message. For help, reply HELP or contact us.

8. Information Sharing with Roofing Professionals

By submitting your information through RoofViz — including your phone number, address, roofing material preferences, and any other details you provide — you understand and agree that:

• Your information may be shared with independent, certified roofing professionals in your area for the purpose of providing you with roofing estimates, consultations, and related services.
• RoofViz acts as a lead generation and visualization platform, not a roofing contractor. We connect homeowners with qualified roofing professionals but do not perform roofing work ourselves.
• Roofing professionals who receive your information are independent businesses. RoofViz does not control, guarantee, or warrant their work, pricing, availability, or conduct.
• You may receive phone calls, text messages, or emails from one or more roofing professionals regarding your inquiry. By submitting your information, you consent to being contacted by these professionals.
• Your information will be handled in accordance with our Privacy Policy, which describes how we collect, use, store, and share your data.

If you do not wish for your information to be shared with roofing professionals, do not submit your phone number or request through the platform.

9. Intellectual Property

All content, software, designs, branding, logos, and platform workflows on RoofViz are the property of RoofViz and are protected by intellectual property laws. You may not:

• Copy, reproduce, or distribute any part of the platform
• Reverse engineer, decompile, or disassemble the software
• Scrape, crawl, or use automated tools to extract data from the platform
• Use RoofViz branding, logos, or materials without written permission
• Create derivative works based on the platform

Rendered images generated through RoofViz may be used by the homeowner for personal purposes and by subscribed contractors for business presentations. Commercial redistribution of renders is prohibited.

10. Acceptable Use

You agree not to use RoofViz to:

• Submit false, fraudulent, or misleading information (including fake addresses or phone numbers)
• Send spam, unsolicited communications, or abuse the platform
• Use automated scripts, bots, or scraping tools
• Attempt to gain unauthorized access to the platform or other users' data
• Use the platform for any illegal purpose
• Harass, threaten, or abuse contractors or other users
• Circumvent usage limits, verification systems, or security measures

Violation of these terms may result in immediate suspension or termination of your account without refund.

11. Dispute Resolution

Any disputes arising from these Terms or your use of RoofViz shall be resolved through:

• Good-faith negotiation between the parties
• If unresolved, binding arbitration in the State of Florida
• Governed by the laws of the State of Florida

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against RoofViz.

12. Indemnification

You agree to indemnify and hold harmless RoofViz, its owners, employees, and affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the platform
• Your violation of these Terms
• Any dispute between you and a contractor
• Any claim related to information you submitted through the platform

13. Modifications to Terms

RoofViz reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the platform after changes constitutes acceptance of the updated Terms.

14. Termination

RoofViz may terminate or suspend your access to the platform at any time, with or without cause, with or without notice. Upon termination, your right to use the platform ceases immediately.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
